Quick answer: Form PE3 is a statutory declaration filed at the Traffic Enforcement Centre to challenge a registered PCN for a moving-traffic or bus-lane contravention in a London borough, a low emission zone, ULEZ or Congestion Charge penalty, or a moving-traffic PCN outside London issued before 1 June 2022. Parking PCNs — in London or anywhere else — use Form TE9 instead. If you’re out of time, file it with Form PE2 (out-of-time application).

For moving-traffic and bus-lane penalties from London borough councils, Transport for London charging penalties (low emission zone, ULEZ and Congestion Charge), and older outside-London moving-traffic penalties (PCN issued before 1 June 2022) that have escalated to a charge certificate, PE3 is the sworn route to unwind the order: a declaration on limited statutory grounds. Parking penalties — wherever issued, London included — take the TE9 witness statement route instead. If your penalty hasn’t yet reached the charge-certificate stage, use the normal council PCN appeal route first.

What is Form PE3?

A statutory declaration (CPR Part 75) used where a PCN in one of these categories has been registered for recovery: a moving-traffic or bus-lane contravention in a London borough; a low emission zone, ULEZ or Congestion Charge penalty; or a moving-traffic contravention outside London where the PCN was issued before 1 June 2022. It states a permitted ground to revoke the order. It must be sworn before a person authorised to administer oaths (e.g. a solicitor or magistrates’ court officer).

Who needs it & when

Owners/drivers facing a registered penalty in one of the PE3 categories above, with a genuine statutory ground. For a parking PCN — including one issued in London — the correct form is the TE9 witness statement, not PE3.

Deadlines & key rules

  • Generally file within 21 days of the order; if late, submit Form PE2 (out-of-time application) with reasons.
  • Grounds: you did not receive the relevant notice; you made representations with no rejection; you appealed with no response; or the penalty is paid.
  • PE3 must be sworn/witnessed; knowingly making a false declaration is a criminal offence.

How to complete it — step by step

  1. Obtain PE3 (and PE2 if out of time) from the TEC.
  2. Select the correct statutory ground.
  3. State the supporting facts truthfully.
  4. Swear the declaration before an authorised person, then submit to the TEC.
